General Conditions of Sale

  • Our terms of payment are strictly card payment, cash or cheque, we do not offer any other terms of credit to the purchaser. All monies exchanged for deposits and balances will be displayed on the contract. Once a deposit has been taken the balance should be paid to the company’s fitters on completion of the installation. Cheques or money orders must be made payable to P&P Windows Ltd, a receipt should be obtained for any cash paid. (At the time this agreement was drawn there are no credit facilities available to the purchaser other than those outlined above. That does not necessarily mean that other methods of payment would not be available to the purchaser in the future).
  • All items are specially made to order and consequently this Purchase Agreement is not subject to cancellation after seven days. If any purchaser after seven days does so cancel, the company shall have the right to retain the deposit and in addition to claim against the purchaser for any further costs or loss of profit which accrues.
  • The purchaser will allow access to the company’s surveyor during normal working hours. The company will arrange such surveys as soon as reasonably possible and reserve the right to cancel this agreement if such surveyor’s report is not satisfactory. If the company does not then it will immediately refund the purchaser any deposit paid.
  • This agreement only applies to the work set out in the attached schedule / design sheet and should the purchaser require any extras they should first be agreed in writing either by letter or a signature on the surveyor’s report. Verbal instructions for the alterations and extras will be confirmed and charged for at a rate decided by the company at the company’s earliest convenience but will not form part of this or any other agreement without written confirmation. The company withhold the right to refuse any request for extra work of any kind.
  • The installation date will be given in good faith and the company will use it to endeavour to comply with this date. However, liability cannot be accepted for any delay caused by circumstances outside the company’s control
  • Subject to the conditions of the preceding clause the company will arrange an installation convenient to the purchaser, but should this date be delayed by the purchaser for a period longer than two months after the signing hereof the company reserves the right to charge the purchaser full price ruling at the time of delivery date and installation.
  • The company will use its best endeavours to use the best glass available but neither the manufacturers or the company guarantees such glass to be completely clear from minor imperfections or distortions. Neither will the company accept responsibility for the breakage of glass after the installation is complete. All glass units are 28mm unless stated on the face of the contract. At the time of this agreement being written, all profiles used in the manufacture of windows, doors and conservatories will be 70mm thick and internally beaded.
  • Please note trims and internal cills may contain extrusion lines and slight imperfections. This is part of the manufacturing process and cannot be accountable.
  • Alterations and Cancellations: It is the responsibility of the purchaser to scrutinise order acknowledgements to ensure that requirements have been interpreted correctly since alterations may be impossible to carry out after manufacturing has commenced. If for any reason other than default or negligence on the part of the company alterations or cancellations are desired, the purchaser will be liable for any additional costs involved.
  • P&P Windows Ltd pursue a policy of continuous development in the standard of its products and manufacturing methods The company reserves the right to modify the design and specifications of its products without notice, and shall be under no obligation to supply goods exactly conforming in appearance to samples or goods previously supplied, provided always that the purchaser’s rights in respect of performance and quality are maintained.
  • Any payment not made by the purchaser within 10 days of the due date shall carry a weekly interest rate of 3% above Lloyds Plc Base Lending Rate. (Unless arrangements have been agreed to at the company’s discretion).
    • Please note that all invoices not settled within our payment terms will be referred to our Debt Recovery Agents, Final Demand Ltd and will be subject to a surcharges of 15% plus VAT in lieu of recovery charges.
  • If the purchaser delays any part of the installation by more than 14 days then a minimum of 50% of the balance will immediately be due.
  • The company reserves the right to cancel all guarantees if for any reason full payment is not made by the purchaser on the due date.
  • Compensation will not be paid by the company either in lieu of rectification of faults or for disturbance of any other reason whatsoever.
  • All diagrams shown on the purchase agreement or survey report are drawn from the outside view.
  • All products will be manufactured to specifications and designs as agreed by the purchaser on the survey report.
  • All designs and sizes shown on the survey report are final. Unless otherwise stated all side openers will be 630mm standard opening. All drops will be 400mm openers.
  • Where planning permission is required, the purchaser will be liable for any charges incurred should permission be denied.
  • Retention of Title: Goods do not become the property of the purchaser until payment has been made in full. In the event of a claim, sellers liability cannot exceed invoice price of defective pieces. The use of glass must conform to the safety requirements of the British Standard Code of Practice BS6262.
  • Product Guarantees: P&P Windows Ltd offer a 10 year manufacturer’s guarantee on products manufactured by themselves. All other product supplied have a 12 months guarantee from our suppliers. Profiles used to manufacture windows, doors and conservatories hold a 10 year guarantee against discolouration. The company offer the purchaser a 2 year manufacturer’s warranty against product failure on e.g. locks, hinges, seals etc., locks should be oiled twice yearly. A 5 year guarantee is offered on double glazed sealed units. The company reserves the right to discontinue to honour a guarantee if the company feels the purchaser has severely mistreated the goods which were originally installed or not maintained them to the standards which are required. All guarantees start from the installation date up until the expiry of the guarantee. Once the guarantee has expired it is up to the purchaser to pay for any costs for repair work etc that may need to be carried out. As P&P Windows Ltd are a FENSA registered company all customers will be sent an insurance backed guarantee within 2-4 weeks of the installation date. This guarantee should be kept in a safe place with a copy of the contract in case a claim is to be made. The insurance backed guarantee is issued to the purchaser by P&P Windows Ltd to safeguard all customers against the cost of repairs should the company cease to trade. The insurance backed guarantee provider will only accept claims from customers who have all copies of the documents required available at the time of the claim.
  • Once the goods have been installed by P&P Windows Ltd, the purchaser holds full responsibility on reporting any faults or problems with the goods and services supplied.
  • It is clearly understood that it is the responsibility of the purchaser that prior to the commencement of the installation the purchaser will remove curtains, blinds, pelmets, carpets, television aerial cables, burglar alarm connections, door bell connections, telephone and any other items impeding the area within which the installation is to take place. The reconnection of any such items rests solely with the purchaser and is not the responsibility of the company.
  • The company does not undertake to move services, fixtures or fittings which are ancillary to the basic structure of the property, e.g. radiators, pipes and electricity, telephone or television cables unless specifically stated in the contract.
  • The company will make good any damage caused in the course of installation to plasterwork, rendering and brickwork immediately surrounding any window or door installed, but the company cannot guarantee the avoidance of superficial damage to surrounding wallpaper, paintwork and ceramic tiles in the same area. The making good of such damage is the responsibility of the purchaser, providing there is no negligence by the company.
  • Conservatories – The groundworks are priced on no more than 600mm depth on strip founds. Any deeper will incur extra costings. Any unforeseen pipes or cables will incur extra costs. Unless otherwise stated on front of the contract. Customers must inform us of any bad land! Example: needs, rafts or piles.
  • All woodgrain door panels carry a 3 year guarantee, all white panels carry a 5 year guarantee and all coloured panels carry a 2 year guarantee. All other work carried out by P&P Windows has a 1 year guarantee. Roofline carries a 3 year guarantee, excluding damage from Act of God.
  • Replacement glass is guaranteed for 5 years, any damage to window frames or beading when changing windows is NOT the liability of P&P Windows.
  • Guarantee not transferable.

BY SIGNING THE CONTRACT THE PURCHAER AGREES TO THE TERMS & CONDITIONS OF THE SALE LAID OUT IN THIS AGREEMENT.
